CamRate Code Of Conduct

We are Camrate Limited ("CamRate") and this Code of Conduct together with the Terms of Service (the "Terms") and Privacy and Cookie Policy (the “PCP”) govern the legal relationship between you and CamRate when you use our rating mobile application (the "App"). The content that you create when using the App whether such content be submitted via the App as text, images, audio or otherwise is referred to as "Content".

  1. Principles: The App is made available to you on the basis you use it to share your personal opinion with others by rating places and things in a way that enables you to express your personal opinion and allow other users of the App (you and each such user being a "User") to respond to your personal opinion and continue the debate should they and other Users so wish. CamRate makes its App available for these purposes and does not condone the use of its App for any other purpose (including any illegal purpose). For this reason, CamRate requires you comply with this Code of Conduct (the "Code") when you use the App and CamRate reserves the right to end your use of the App and to remove your Content if CamRate believes you breach the Code. CamRate may modify the terms of this Code, in its sole discretion, by posting amended terms to the App. Your continued use of the App indicates your acceptance of the amendments. Words with capitals used in the Code shall have the same meaning as the meaning given to them in the Terms.

  1. Data Protection: Your may wish to include photos of other people and references to their names and their personal details. If you decide to do so, you must comply with your legal obligations the UK Data Protection Act 1998. For example:

    1. you must have received permission before you take a photo of an individual for use on the App, or if you wish to use their name or any information about them. You must tell an individual what purpose the photo is to be used for;

    2. you must immediately take down photos or information relating to an individual if they ask you to do so;

    3. you will not post any other person’s identification documents or sensitive medical or financial information; or

    4. you will not take photos of minors or provide any information in relation to minors to upload to the App;

We also refer you to the PCP and to the Terms in relation to your obligations to comply with laws other than the laws of England and Wales that may apply to the App.

  1. Content Restrictions: You will not input or upload Content to the App that is:

    1. is unlawful, harmful, threatening, abusive, harassing, defamatory (being content that in general terms lowers a person in the estimation of people, causes people to shun or avoid a person or subjects a person to ridicule, hatred or contempt), invasive of another’s privacy, discriminatory, menacing, scandalous, blasphemous, in breach of confidence (being content imparted to you under a duty of confidence or that is not otherwise publicly available) or is harmful to minors in any way;

    2. is pornographic;

    3. harasses, degrades, intimidates or is hateful toward an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability;

    4. impersonates any person or entity, including, but not limited to, a CamRate employee, or falsely states or otherwise misrepresents your affiliation with a person or entity;

    5. is false, deceptive, misleading, or deceitful;

    6. constitutes or encourages conduct that would be considered a criminal offence, give rise to civil liability, or otherwise be contrary to the law of or infringe the rights of any third party, in any country in the world;

    7. infringes any patent, trade mark, trade secret, copyright or other intellectual property or proprietary rights of any party, or Content that you do not have a right to make available under any law or under contractual or fiduciary relationships. Such content might include quotes, text from other sources, photos, other images and music or video files;

    8. constitutes or contains “affiliate marketing,” “link referral code,” “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or unsolicited commercial advertisement;

    9. constitutes or contains any form of advertising or solicitation;

    10. includes links to commercial services or websites;

    11. advertises any illegal service or the sale of any items the sale of which is prohibited or restricted by any applicable law;

    12. contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;

    13. disrupts the normal flow of dialogue with an excessive amount of Content (flooding attack) to the App, or that otherwise negatively affects other users’ ability to use the App; or

    14. employs misleading email addresses, or forged headers or otherwise manipulated identifiers in order to disguise the origin of Content transmitted through the App.

  1. Conduct Restrictions: You also agree not to:

    1. collect personal data about other users for commercial or unlawful purposes;

    2. use automated means, including spiders, robots, crawlers, data mining tools, or the like to download data to or from the App – unless expressly permitted by CamRate;

    3. post irrelevant Content, repeatedly post the same or similar Content or otherwise impose an unreasonable or disproportionately large load on the App;

    4. attempt to gain unauthorised access to CamRate’s computer systems or engage in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of, the App; or

    5. use any form of automated device or computer program that enables the submission of Content on the App without each item of Content being manually entered by the author thereof (an “automated posting device”), including without limitation, the use of any such automated posting device to submit Content in bulk, or for automatic submission of Content at regular intervals, or engage in any other acts which could be considered “gaming the system”.

  1. All Content posted on the App must comply with our Terms and, in particular, this Code. CamRate may remove or block your access to any of your Content from the App that does not so comply.

  1. If you are worried that there is Content about you in relation to which you have legal rights against a User please contact CamRate (using the details provided in the Terms) with the following information:-

    1. who you are (or, if applicable, who you represent) – and evidence of your identity;

    2. how CamRate may contact you;

    3. where you found the Content which is the subject of your complaint (including a links or screenshots to any relevant Content);

    4. a brief explanation as to why the Content should be removed from the App.

  1. CamRate envisages that complaints a third party makes may concern ownership of intellectual property rights, data protection, defamation and privacy issues. Upon CamRate’s receipt of the information requested in Paragraph 6 above, CamRate may:-

    1. acknowledge receipt of the notification by e-mail and make an initial assessment of the validity and plausibility of the complaint;

    2. if CamRate believes the complaint to be a valid and plausible, remove the Content from the App or block access to it pending resolution of the complaint;

    3. at CamRate’s discretion take legal advice (if CamRate deems it necessary to resolve the complaint) and/or contact the User who published the Content and invite them to respond to the complaint made;

    4. mediate between the complainant and/or their representative and the contributor to resolve the complaint to everyone’s mutual satisfaction;

    5. Camrate may then either: (i) leave the Content unchanged and restore access to the App; (ii) require the Content to be modified; (iii) permanently remove the Content; and (iv) suspend or terminate the User’s right to use the App.

  1. CamRate also complies with international copyright laws including 17 U.S.C. 512 and the Digital Millennium Copyright Act (“DMCA”). It is CamRate’s policy to respond to any infringement notices and take appropriate actions under the DMCA and other applicable intellectual property laws. If you are a copyright owner or an agent thereof and believe that any file or other Content or link infringes upon your copyrights, you may submit a notification pursuant to the DMCA by providing us with the following information in writing (see 17 U.S.C 512(c)(3)):

    1. a physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;

    2. identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;

    3. identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled and information reasonably sufficient to permit CamRate to locate the material;

    4. information reasonably sufficient to permit CamRate to contact you, such as an address, telephone number, and, if available, an electronic mail;

    5. a statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and

    6. a statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
